How to hire employees in Panama as a foreign company

Juan Carlos Acosta, CPA

You can hire employees in Panama as a foreign company, and many companies do. Hiring is not the hard part. The hard part is knowing the true cost of each employee and staying compliant every month with three bodies: the Social Security Fund (CSS, for its Spanish name), the Labor Code and the tax authority (DGI).

This guide covers your options, what an employee really costs on top of salary, how Panama payroll works and the mistakes we see most often.

How to hire employees in Panama: your three options

There are three main routes. Each one changes who the legal employer is.

OptionWho is the employerWhen it usually makes sense
Employer of record (EOR)A third party registered with the CSSA few employees, testing the market, no income in Panama
Branch of your foreign companyThe Panama branchStable operations, with the parent company as owner
Panamanian company (subsidiary)The subsidiaryGrowing team, local income, long-term operations

Employer of record. A provider is registered as the employer with the CSS and handles salaries, contributions and statutory benefits. Your company does not need to set up a legal entity in Panama. The trade-off: you rely on a third party for the employment relationship.

Branch or subsidiary. Your company hires directly. For tax purposes, a branch is a taxpayer separate from its parent company. It keeps its own books and pays its own taxes. Branch profits are subject to a 10% dividend tax, with the adjustments the law provides.

ARVA does not incorporate companies or register branches. We work with lawyers for that. We take care of what comes next: accounting, payroll and taxes. See our page on foreign companies in Panama.

Registering as an employer with the CSS

Before your first employee starts working, the entity must be registered as an employer with the Caja de Seguro Social (CSS), Panama’s Social Security Fund. Each employee must be registered too.

From then on, the company reports its payroll and pays contributions every month through SIPE, the CSS online payroll system. Payment is due the month after the period worked.

If your company already operates in Panama, it will also have obligations with the DGI. Our guide on taxes for companies in Panama explains them.

What does an employee cost in Panama on top of salary?

Salary is only part of the cost. These are the main employer charges:

ItemCost to the employer
Social security (CSS)13.25% of salary since April 2025; 14.25% from March 1, 2027; 15.25% from March 1, 2029
Education insurance1.50% of salary
Occupational risk insurance0.33% to 6.25% depending on the activity
Thirteenth-month bonusOne month of salary per year, in three installments
Vacation30 paid days for every 11 months worked
Seniority premiumOne week of salary per year worked, on indefinite-term contracts

The employee also contributes 9.75% to social security and 1.25% to education insurance. The company withholds these amounts from salary and pays them together with its own contribution.

The thirteenth-month bonus (décimo tercer mes)

The thirteenth month equals one month of salary per year. It is paid in three installments: April 15, August 15 and December 15. Each installment is calculated on what the employee earned during the four-month period, divided by 12.

The bonus has its own employee social security deduction of 7.25%.

Vacation, seniority premium and severance fund

Employees are entitled to 30 days of paid vacation for every 11 continuous months of work.

On indefinite-term contracts, the employee receives a seniority premium when the relationship ends. It equals one week of salary for each year worked, whatever the reason for termination.

To cover that premium and certain severance payments, the employer must keep a severance fund (fondo de cesantía). Contributions are made quarterly under Law 44 of 1995.

If you budget for salary only, expect surprises in April, August and December.

Employment contracts and the Labor Code

Employment in Panama is governed by the Labor Code, even when the employer is foreign. A few points to keep in mind:

  • Written contract. Put the terms, salary and working hours in writing.
  • Probation period. It can be agreed for up to three months, as long as it is stated in the written contract. It is not valid if the person returns to a position they already held at the company.
  • Minimum wage. It is set by decree and varies by region, activity and company size. There is no single national figure.
  • Indefinite-term contract. It triggers a seniority premium at termination, for any reason.

Drafting the contract is a job for an employment lawyer. We calculate its cost and build it into your payroll.

Work permits for foreign employees

If you plan to relocate foreign staff to Panama, you need a work permit from MITRADEL, Panama’s Ministry of Labor. The application is filed through a lawyer and also requires the right immigration status.

Under the Labor Code’s general category, there are percentage limits:

  • Ordinary staff: within 10% of the total workforce.
  • Specialists or technicians: within 15%.
  • Trusted staff (personal de confianza): within 15%.

Separate categories exist for free zones, special laws and investment policies. A foreign employee working in Panama contributes to the CSS and pays income tax like any other employee. Their salary is Panama-source income.

Common mistakes when hiring in Panama from abroad

  1. Paying the employee as a contractor from abroad. If the person works under your direction and on a set schedule, it may be an employment relationship with all its charges.
  2. Budgeting for salary only. Contributions, the thirteenth month and vacation raise the cost significantly.
  3. Forgetting the scheduled employer contribution increases. Law 462 of 2025 raises the rate in March 2027 and again in March 2029.
  4. Registering the employee late with the CSS. Registration must be in place before the first day of work.
  5. Bringing in foreign staff without checking the allowed percentage. The limit is calculated on your Panama payroll.
  6. Not reconciling payroll with the books. Differences surface later, during a tax audit.

Frequently asked questions

Can a foreign company hire employees in Panama without setting up a local entity?

Yes, through an employer of record (EOR). The EOR is registered as the employer with Panama's Social Security Fund (CSS) and runs payroll for you. If you prefer to hire directly, you need a legal presence in Panama, such as a local company or a registered branch, enrolled as an employer. The right option depends on how many people you will hire, how long you plan to operate and whether you will earn income in Panama.

How much does an employee cost in Panama on top of salary?

The employer pays social security (13.25% since April 2025), education insurance (1.50%) and occupational risk insurance (0.33% to 6.25% depending on the activity). It also pays the thirteenth-month bonus, equal to one month of salary per year, and 30 days of paid vacation for every 11 months worked. Indefinite-term contracts also accrue a seniority premium.

When is the thirteenth-month bonus paid in Panama?

The thirteenth month equals one month of salary per year and is paid in three installments: April 15, August 15 and December 15. If it is paid later by agreement with the employee, the Ministry of Labor (MITRADEL) has stated that a 10% surcharge applies. The bonus has its own employee social security deduction.

Can I bring a foreign employee to work for my company in Panama?

Yes, but you need a work permit from the Ministry of Labor (MITRADEL), filed through a lawyer. Under the general category, ordinary foreign workers cannot exceed 10% of the total workforce. Specialists or technicians and trusted staff have a 15% limit. Special categories exist for free zones and special laws.
